会社じゃないのに会社と名乗るな！！

最近感じる事として、個人事業主のサイトで、会社でもないのに、「会社概要」とか、「会社名」と書いているホームページをよく見かけます。
最近はホームページで広報活動ができ、パンフレットやチラシの作成の次の段階にいっていますが、
この事が凄く気になるというか、腹立たしく思っています。
まず、単に会社法はじめ国語辞典をよく読んでいないのかなと思う訳です。
辞書を引くと会社とは、

営利を目的とする社団法人で、商法による株式会社・合名会社・合資会社と有限会社法による有限会社の総称。また、商法・有限会社法以外の法律により設立される、銀行・相互会社・信託会社などと特殊会社とを含めても用いられる。


つまり、会社とは、現在設立出来る「株式会社」「合同会社」、旧法で設立出来る「有限会社」「合名会社」「合資会社」。保険業法の「相互会社」ぐらいなもんです。


それ以外は、事業者なんです。
個人事業主が店を開けば、「屋号」「商号」「店名」などになる訳です。
個人事業主は万といる訳ですが、会社じゃなく「店名」や「屋号」を書けばいいだけの話です。
それをそこまでして、会社と名乗りたいのなら会社を作ればいいだけの話です。
「株式会社」や「合同会社」は【定款】と【資金】を準備し法務局に届ければいくらでも労力はかかりますが、作れる訳です。
また、非営利特定活動法人(NPO法人)はじめ財団法人、社団法人、医療法人、学校法人、宗教法人など法人格があれば会社ではなく法人名な訳です。
それを理解していない人があまりにも多すぎる訳です。
最終的には「法人」か「個人」な訳です。
法人は登記なりを通過し法の上で人と見なす訳です。
　
よく私も、会社概要と書いている人に、よく「株式会社」ですか？と聞くと、個人事業主ですと言われ、幻滅する事があります。
もう少し、世の中の常識を考えて欲しいものです。
